These Terms of Service (“Terms”) govern your use of Kickoff eSIM at kickoffesim.com and the purchase of prepaid eSIM data plans through our website.
1. About our service
Kickoff eSIM resells prepaid mobile data eSIM plans for travel and events. We are not a mobile network operator. Connectivity is provided through partner carriers and our eSIM provisioning provider. Coverage, speeds, and availability depend on the plan you purchase and local network conditions.
2. Eligibility
You must be able to form a binding contract in your jurisdiction to use our service. You are responsible for ensuring your device supports eSIM and is unlocked (where required).
3. Accounts and guest checkout
You may purchase with a signed-in account (Google or email link via Firebase) or as a guest by providing an email address. You are responsible for keeping your sign-in credentials secure and for activity under your account.
4. Orders, pricing, and payment
- Prices are shown in the currency you select at checkout (CAD, USD, EUR, or GBP). The amount charged at payment matches the currency and price displayed for your order.
- Payment is processed by Stripe. By completing a purchase, you authorize us to charge your payment method for the displayed total.
- We may refuse or cancel orders in cases of suspected fraud, pricing errors, or service unavailability.
5. Delivery
After successful payment, we provision your eSIM and make installation details available through your account or guest order link (typically a QR code). Delivery is usually immediate but may take longer during maintenance or provider outages.
You are responsible for installing the eSIM correctly and before any plan validity period begins, as stated on the product page.
6. Acceptable use
You agree not to misuse the service, resell plans in violation of provider terms, or use connectivity for unlawful activity. We may suspend or terminate access for violations.
7. Refunds
Refund eligibility is described in our Refund Policy. Digital eSIM products may not be refundable once issued or activated.
8. Disclaimers
THE SERVICE AND eSIM PLANS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE UNINTERRUPTED COVERAGE, SPECIFIC SPEEDS, OR COMPATIBILITY WITH EVERY DEVICE OR APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KICKOFF ESIM AND ITS OPERATORS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
10. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above indicates the current version. Material changes may be communicated on the website. Continued use after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Canada, without regard to conflict-of-law principles. Disputes shall be subject to the courts of competent jurisdiction in Canada, unless otherwise required by mandatory consumer protection laws in your country of residence.
